What should you do when dealing with a high maintenance beneficiary? What do probate registrars want to see when you open a case for probate? University of Denver Sturm College of Law Professors, skilled practitioners, and judicial officers will answer these and other questions, along with advice from the bench for litigators in the court room. This program will offer practical probate tips for attorneys and their staff.  Krista Garcia, the Probate Registrar for the Boulder County District Court, will provide essential tips on opening probate and communicating with the Court. Jennifer M. Spitz, an attorney with over 20 years of probate experience, will add some real-world guidance on select estate administration matters.

Estate Planning for Tribal Communities
In 1887, Congress initially enacted legislation that transformed the rights of tribal members with respect to their ownership and use of their native lands.  This legislation has been amended and replaced over time, most recently with the American Indian Probate Reform Act (AIPRA), passed in 2004 and amended in 2008.  This panel presentation will provide an overview of AIPRA and its limitations and constraints that substantially affect the descent of a tribal member’s interests in trust lands at death. It will help practitioners understand the considerations that should be taken into account when working on estate plans for tribal members.  Additionally, the presentation will discuss various cultural considerations that play an important role in the discussions that an estate planning practitioner may have with a tribal member client.
