About the Book:
Colorado Civil Claims provides an overview of civil claims under Colorado law. Originally published in 2005, its chapters had last been supplemented in 2008. Ten years on, the time was at hand for a new, fully updated edition. Several features should make this book easy to use. First, claims appear in alphabetical order as lawyers refer to them; thus, “Breach of Contract,” and not “Contract, Breach of.” Second, each chapter’s content is generally presented in the same order. The claim is briefly described at the outset, followed by a short summary of its elements. The elements are then discussed in more detail, followed by sections on defenses and remedies. (Subheadings and occasional variations on this format appear where the authors or I believed they would be helpful.) Third, each chapter concludes with an exhibit consisting of a template complaint, showing how the claim might be alleged in a Colorado district or county court action. Fourth, the softbound format will make the book lighter to carry, easier to photocopy or scan, and less costly for CBA-CLE to publish and update. Finally, purchasers will also receive an electronic version to store and use on a computer, tablet, or smartphone.
It is critical to note that our objective was not exhaustive research or law review-level scholarship. Not every Colorado civil claim is included here, though we anticipate others will be added in future editions. Nor is every possible defense or remedy described, since these may vary significantly based upon the underlying facts or applicable case law, statutes, or court rules. Thus, readers should always expand upon these introductory descriptions and citations with their own thorough research and analysis.
