Program Description
Water Law 201 is the second course in the Water Law and Administration Program Series. This program will include a very brief look at Water Law 101 as a starting point and will then explore in detail the two key doctrines in Water Law which insure that, in the grand scheme of things, the water resource is available in the requested amounts at the specified locations and that the proposed plan will be developed for future enjoyment. The Doctrines of “Can and Will” and “Anti-Speculation” have evolved over more than a century of water law applications and the critical lessons learned during this vital experiment. Discussion of the historic case of Thornton v. Bijou Irrigation District will illustrate many of the facets of water development in Colorado including appropriation requirements, operational techniques, the transbasin water regime, injury prevention, administrative deliberations, and water quality considerations. Your faculty are the experts who know the system, lived the history, and who will guide you to understand the necessary and sufficient elements of successful water development. This program is critical to your understanding of Colorado Water Law.
