Civil litigation is fraught with ethical dilemmas for attorneys, from working with expert witnesses to communications with opposing counsel.  Led by an All-Star panel, this two-part program will examine several major areas of potential liability, including conflicts of interest, ethics in discovery and issues involving settlements.  Taking a practical perspective, the program will be driven by scenario-based discussions.  The program will also incorporate a review and analysis of case law and rules-based developments.

Pamela A. Bresnahan is a partner in the District of Columbia office of Vorys, Sater, Seymour and Pease LLP, where she represents lawyers, accountants, financial consultants, other professionals and E&O insurers in professional responsibility litigation.  She also represents corporations in commercial, securities and IP litigation.  She has served in the American Bar Association House of Delegates since 1988 and is a former D.C. Circuit Representative on the ABA Standing Committee on the Federal Judiciary. She is a Past Chair of the Standing Committee on Lawyers' Professional Liability and served on that Committee for six years.  She also served on the Standing Committee on Lawyers' Responsibility for Client Protection.   Ms. Bresnahan is a Fellow of the American Bar Foundation and is listed in Best Lawyers' in America under legal malpractice law and business and commercial litigation. She presently serves as President of the American Counsel Association.  Ms. Bresnahan received her B.A. from the University of Maryland and her J.D. from the University of Maryland School of Law.
 
Lucian T. Pera is a partner in the Memphis office of Armstrong Allen, PLLC.  His practice includes professional malpractice litigation as well as counseling lawyers and law firms in the area of ethics and professional responsibility.  A member of the ABA's Ethics 2000 Commission, he is the co-author of Ethics and Lawyering Today, a national e-mail newsletter on lawyer ethics, which is available on his Web site: www.ethicsandlawyering.com.  Mr. Pera is a graduate of Princeton University, where he received his A.B. with honors, and Vanderbilt University School of Law, where he received his J.D.  After leaving law school, he served as a judicial clerk to Judge Harry W. Wellford of the U.S. Court of Appeals for the Sixth Circuit.
 
Kevin S. Rosen is a partner in the Los Angeles Office of Gibson, Dunn & Crutcher, where his practice focuses on business and commercial litigation in state and federal trial and appellate courts across the country, with an emphasis on consumer fraud, unfair competition, legal malpractice defense, health care litigation, intellectual property litigation, securities litigation, real estate litigation, and general business disputes.  Mr. Rosen serves as the Chairman of the firm's Legal Malpractice Defense Practice Group and has successfully defended dozens of high-stakes cases for law firms across the United States.  Before joining his firm, Mr. Rosen was a judicial clerk for Judge William Keller of the U.S. District Court for the Central District of California.  He received his undergraduate degree magna cum laude from Dartmouth College and his law degree from Columbia University School of Law, where he was designated a Harlan Fiske Stone Scholar in each of his three years.
