Program Description:
 
This program will provide you with a wide-ranging review of case law and other developments related to sexual harassment and discrimination claims in employment law. The program will cover growing categories of harassment claims, including those based on pregnancy, stereotyping and same-sex harassment.  The program will also cover how the advent of texting and social media contribute to creating a hostile work environment, and claims based on off-site activities of employees.  Developments related to an employer's affirmative defense under the Farragher and Ellerth line of cases will also be covered.  This program will provide you with a practical guide to case law and related developments in the last two years related to sexual harassment.
 
- Review of major case law developments impacting sex harassment litigation
- Stereotyping, same-sex harassment, and pregnancy-based harassment
- Off-site harassment, texting, emailing and social media contributing to a hostile work environment
- Supervisor harassment - who is a supervisor and was tangible employment action taken?
- Employer liability for co-worker and third-party harassment
- Developments related to the the Farragher and Ellerth affirmative defense
 
Faculty:
 
Ernie Haffner is a Senior Attorney-Advisor in the EEOC's Office of Legal Counsel in Washington, D.C., where he is primarily responsible for drafting policy documents under Title VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act, and the Equal Pay Act.  In addition to drafting policy documents, he provides training and other outreach on sexual harassment and other EEO issues.   He also authored the chapter "Harassment Because of Gender," in the newly published treatise “Workplace Harassment Law,” edited by Barbara Lindemann and David Kadue.  Mr. Haffner received his B.A. from the University of Maryland and his J.D. from American University in Washington, D.C.
 
Andrew S. Rosenman is a partner in the Chicago office of Mayer Brown, LLP, where he has an extensive employment law practice, including the defense of employers, in administrative hearings, trial and appeal, of claims of harassment based on sex, national origin, race and religion.  He also has substantial experience in wage and hour and workers' compensation claims.  He has been quoted wide quoted in the legal and general media on employment law matters, including the New York Times and USA Today.  Mr. Rosenman received his B.A. from the University of Michigan and his J.D., with high honors, from the Illinois Institute of Technology Chicago-Kent College of Law.

Each program will run from 11:00 a.m. to 12:00 p.m. M.T. (60 minutes each).
