Program Description:
Age discrimination claims are on the rise as consequence of two clashing trends - an aging workforce, on the one hand, and employers forced by challenging economic conditions to reduce their work rolls and/or change corporate policies, which often adversely impact more senior workers, on the other hand. The EEOC has also issued regulations that seemingly curtail the “reasonable factor other than age” defense to adverse impact claims.  Even when an age discrimination claim fails to advance on its own terms, age claims can live on in the form of retaliation claims.  This program will provide you with an update of major case law and regulatory developments impacting age discrimination claims, including adverse impact claims involving layoffs and job reassignments, retirement and health benefit issues, the affirmative defense to adverse impact claims, and recent EEOC regulatory and enforcement activity.

Faculty:
 
Raymond Peeler is a Senior Attorney-Advisory in the Equal Employment Opportunity Commission Office of Legal Counsel in Washington, D.C., where he assists the Commission in interpreting and applying the statutes it enforces, participates in drafting policy guidance, and represents the EEOC in policy discussions with other agencies. His duties have included representing EEOC in the Interagency Taskforce for the Aging of the American Workforce.  Mr. Peeler received his B.A. form Washington and Lee University and his J.D. from Georgia State University College of Law.
 
Jeff Grube is a partner in the San Francisco office of Paul Hastings, LLP, where he represents and advises employers in all aspects of employment law, with a particular emphasis on disability accommodation, wage and hour class actions, independent contractor agreements, wrongful termination, and equal employment opportunity litigation. Mr. Grube is assistant editor of the third edition of the ABA's treatise “Employment Discrimination Law” (1996) and is a management member of the EEO Committee of the ABA's Labor and Employment Section.  Mr. Grube received his B.A. from the University of California - Irvine and his J.D. from the University of Southern California Law School.
