Program Description:
Trust and estate disputes range from minor disputes to raging battles involving the volatile combination of money, emotion, and family rivalries. Even when a state does not mandate or strongly encourage mediation, parties often seek mediation to resolve these disputes more rapidly and cost-effectively than through formal litigation. Successful mediation depends on counseling clients about setting reasonable expectations, crafting a mediation strategy aligned with the nature of the underlying dispute, and yet keeping an eye on potential traps if mediation fails and litigation ensues. This program will provide you with a real world guide to crafting effective strategies for mediation of trust and estate disputes.

Faculty:
Steven B. Malech is partner in the New York City office of Wiggin and Dana, LLP, where he is chair of the firm’s probate litigation practice group. He is represents beneficiaries, fiduciaries and creditors in disputes involving alleged violations of the Prudent Investor Act and its predecessors, alleged breaches of fiduciary duty, disputed accountings, and will contests. He represents clients in cutting edge probate litigation matters involving trusts and estates with assets in the hundreds of millions of dollars. Mr. Malech received his B.A., with special honors, from the University of Texas and his J.D. from the Connecticut School of Law.
Robert F. Walker is a partner in the Jackson, Mississippi office of Baker, Donelson, Bearman, Caldwell & Berkowitz, P.C., where he litigates business and individual tax controversies at the administrative and judicial levels. He also has an active probate litigation practice involving will contests, trust disputes and breaches of fiduciary duties. He is a Certified Information Privacy Professional and a member of the firm’s Privacy and Information Security Team. Mr. Walker received his B.B.A., cum laude, from Millsaps College and his J.D., magna cum laude, from the University of Mississippi School of Law.
