Program Description:

Trust and estate disputes range from minor disputes to raging battles involving the volatile combination of money, emotion, and family rivalries.  Even when a state does not mandate or strongly encourage mediation, parties often seek mediation to resolve these disputes more rapidly and cost-effectively than through formal litigation. Successful mediation depends on counseling clients about setting reasonable expectations, crafting a mediation strategy aligned with the nature of the underlying dispute, and yet keeping an eye on potential traps if mediation fails and litigation ensues. This program will provide you with a real world guide to crafting effective strategies for mediation of trust and estate disputes.

- Crafting effective mediation strategies in trust and estate disputes
- Types of disputes more v. less amendable to mediated resolution
- Family business, spousal, discretionary distribution, undue influence & other disputes

- Confidentiality and other issues to be wary of if mediation fails & litigation ensues
