Planning for incapacity or death is critical for solo and small firm practices.  Failure to plan has consequences, including the involvement of Inventory Counsel.  Succession planning provides you with the ability to control how the firm is dealt with during incapacity or death, the potential to retain more value from your firm, and can keep you in compliance with the Rules of Professional Conduct.  This presentation will discuss some of the outcomes if a solo or small firm attorney has not planned for sudden incapacity or death, the Rules of Professional Conduct that are applicable to succession planning, and the process for creating a succession plan.
