The Economic Loss Rule: What You Don’t Know CAN Hurt You

In Partnership with the Colorado Bar Association Solo/Small Firm Section

Program Description

The breadth and depth of the economic loss rule is far greater than most attorneys realize. Under Colorado law, claims for fraud, such as intentional concealment and intentional nondisclosure, can be barred by the economic loss rule. This presentation will cover the basics of the economic loss rule, an analysis of how certain seemingly innocuous contractual provisions can trigger the economic loss rule in later litigation, and drafting tips to avoid the pitfalls of the economic loss rule.
