Do You Really Want to be the Daily Deal?
Ethical Considerations for Lawyers Using Deal of the Day Websites
 
In challenging economic times, lawyers are faced with dual dilemmas about how to attract business while still complying with their ethical obligations under the Rules of Professional Conduct. Just when we thought advertising issues had all been addressed, along come Groupon™, Living Social™, and similar websites offering lawyers the opportunity to broaden their public exposure through offering discounted legal services; but the use of these websites may pose risks for the unwary.
 
This program will pose numerous questions relating to lawyer use of “deal of the day” websites, including discussion of the potential implications the Colorado Rules of Professional Conduct may have on the use of such services.

Amy C. DeVan Esq., is Assistant Regulation Counsel for the Colorado Supreme Court Office of Attorney Regulation Counsel in Denver, Colorado. In this role, she investigates allegations of lawyer misconduct pursuant to the Rules of Professional Conduct. Prior to joining the Office of Attorney Regulation Counsel in 2010, Amy was employed in private practice for nine years with a boutique immigration law firm in the metro area. A graduate of the University of Colorado School of Law, Amy is also a member of the Colorado Bar Association, where she serves on the Bar Association Ethics Committee and chairs the Education Subcommittee of the Ethics Committee.
 
 
Ericka F. Houck Englert

Ericka F. Houck Englert, Esq.,  is an Assistant Regulation Counsel with the Supreme Court Office of Attorney Regulation. Before joining the Office of Attorney Regulation Counsel, she represented individuals and businesses primarily in the areas of commercial and intellectual property litigation for several years at Brownstein, Hyatt, Farber, Schreck LLP, and has also clerked for Chief Justice Michael L. Bender of the Colorado Supreme Court, practiced products liability and franchise litigation, and served as a prosecutor for the City and County of Denver. Ms. Englert was the publications co-chair for the board for the CWBA in 2011 and is the board chair of Colorado Youth Matter, a non-profit committed to reducing teen pregnancy and promoting teenage sexual health. She has served on the board of Culturehaus and the Board of Governors for the Colorado Bar Association. Ms. Englert is a graduate of the Colorado Bar Association Leadership Training program and a current participant in Impact Denver with the Denver Metro Chamber.
