What will happen to your solo/small firm practice in the event of your disability or death? Do you have a plan?  The vast majority of solo and small firm types don't!  This presentation reviews a few different scenarios of what might happen when there is no planning. The presenter also discusses the lawyer's fiduciary duty to clients and why some kind of a plan should be in place. Checklists, forms and other resources are discussed and provided in the materials, including planning for “if” (disaster and disability, including a limited power of attorney to allow a colleague to manage or close a practice) and “when” (including will provisions for death of a solo, death of a practice). Finally, the presenter discusses how to find an assisting attorney (another like-minded solo type perhaps) and the role of inventory counsel at the Office of Attorney Regulation.

About the Faculty:
 
Barbara Cashman, Esq., has been a solo practitioner focused on estate and life planning, elder law and mediation, probate and estate administration since opening her own law office in 2008. Prior to becoming a solo, she spent the majority of her twenty-two year legal career in federal court, and also stayed at home for a few years to raise her kids. Barb values her client relationships and strives to honor and incorporate the human and compassionate face of law practice in counseling and representing her clients, and this is also true for her approach to mediation. Formerly a “boomer sandwich” (three teenage sons and octogenarian parents until 2011), this gives Barb the life experience that informs the counseling she does with her clients.
