Colorado Foreclosure Law: When Dirt Goes South

Whether representing borrowers or lenders, you need to know more than the basics when dealing with troubled real estate secured loans. Colorado's foreclosure statutes have been revised by the most sweeping changes since the re-codification in 1990. Rich Krohn will lead you through how those changes affect your practice and let you know which changes are effective now and which become effective July 1, 2007.
Bob Brown and Ed Cordes will lead a discussion of basic-to-advanced receivership issues and focus not only on substantive legal issues and procedures, but on the practicalities of dealing with receivers from the perspective of lenders, borrowers, and creditors, as well as on being a receiver. They will also discuss novel and creative uses of receiverships which can benefit you and your clients in situations other than defaulted real estate secured loans.
Finally, Kim Tyson will provide to you the information all real estate lawyers need to know about real estate and defaulted loans in bankruptcy, including the use of single-purpose entities, strategies to quickly secure the release of real estate collateral from bankruptcy, and maintaining the state court receiver in possession following bankruptcy filing. Kim will also focus on the impact of the new bankruptcy law which became effective last fall.
