--The Fifth Amendment to the United States Constitution
Eminent domain is the power of a government to acquire private property for public purposes. The Takings Clause, the last clause of the Fifth Amendment, limits the government's power of eminent domain by requiring that just compensation be paid if the government takes private property for public use.
