Environmental Liability in Real Estate Transactions
 
Do you know the different types of environmental pollutants and contaminants? Or, how to conduct environmental due diligence prior to entering into a real estate transaction? What is required to be disclosed and to whom? Spend this day introducing yourself to the liabilities that pollutants and contaminants
pose in real estate transactions.
 
From soil to groundwater to air, do you know where environmental pollutants and contaminants are going to appear? Our morning introduces you to these different types of liabilities and also provides an overview of the federal and state laws, including CERCLA. You will also learn about the importance of conducting due diligence prior to entering into or finalizing a real estate transaction. The morning
continues with a segment on reporting requirements and disclosures. It concludes with important information on how to structure your deals while minimizing risks.
 
The afternoon session focuses on remedial solutions when pollutants and contaminants are found. It begins with a segment on environmental insurance - the scope of a policy as well as its pitfalls. Next, the option of voluntary cleanup is discussed by one of Colorado's leading experts in the area. The day concludes with a look at environmental covenants.
