The FinCEN Rule – Anti-Money Laundering Regulations
In 2015 the New York Times reported that about $8 billion was spent in New York City for residences that cost more than $5 million each. Of that $8 billion, more than half of those sales were to shell companies. The estimated amount of total money laundered annually around the world is 2-5% of the global GDP (between $800 billion and $2 trillion).
Effective March 1, 2026, attorneys assisting clients in residential real estate transactions – whether through deed preparation and/or recording, or by evaluating title status – completed as non-financed “cash” sales will be subject to substantial reporting requirements imposed by the U.S. Department of Treasury’s Financial Crimes Enforcement Network (FinCEN).
The program offers an overview of the attorney’s reporting requirements and identifies the significant civil and criminal liability consequences of failing to comply.

The program is accredited in Colorado. CBA-CLE staff can provide a Uniform Certificate of Attendance, and it is the attendee's responsibility to complete the accreditation outside of Colorado.
