Trust & Estate Fall Update - In-Person
Join the T&E Section for important fall updates. An experienced panel of practitioners will provide perspectives on ADR in Trust and Estate planning, including a discussion of red flags, common issues, and sample forms. We’ll cover reformation actions and no-contest clauses, and conclude the day with an insightful presentation on cultural diversity in the field.

Home studies will be available approximately 2-3 weeks following the live program.

Reformation Actions under the Colorado Probate Code & Colorado Uniform Trust Code
The doctrine of reformation is a relatively new concept in trust and estate law. The goal of this presentation is to provide lawyers with an overview of the law of reformation and its origins, and a discussion of applicable standards of proof and evidentiary issues that may arise in a reformation action. The presentation will include a case study from a Colorado reformation action for discussion.

No-Contest Clauses: Recent Developments, Multi-State Conflicts, and More
In this presentation, we will review the principles of Colorado law governing in terrorem clauses, also known as "no-contest" or "forfeiture" clauses, in wills and trusts. While Colorado law has remained stable in this area, we will also examine recent decisions from other states which can help you refine best practices when drafting no-contest clauses, or administering trusts and estates which are subject to no-contest clauses.
