The Intersection of Divorce and the Creation of Trusts During a Marriage - Webinar
Ever since 2001 when the Colorado Supreme Court decided In re Marriage of Balanson, trusts have been a hotly litigated issue in Colorado divorces. Usually trust issues arise in Colorado divorces when one party is a beneficiary of one or more trusts that were created by their parents or grandparents. But what about trusts that are created by one or both parties during the marriage? Are they relevant to later divorce proceedings? And if so, how? Does it matter if one or more parties are beneficiaries of the trust? Whether it is revocable or irrevocable? Or how it was funded? What jurisdiction does a Colorado divorce court have over the trust? And how can orders affecting a party’s beneficial interest in an irrevocable trust created during the marriage be enforced? This presentation will answer those questions and more!
