Planning for state income taxes on trusts is a critical aspect of the estate-planning process. If done well, it can produce substantial benefits; if done poorly, it can produce substantial avoidable costs.  This session will briefly survey how all states tax trust income, focus on Colorado's approach, and describe how to handle the issue for trusts and beneficiaries moving to and from Colorado.

Great care should be taken in naming trusts as beneficiaries of an IRA or qualified plan if the desire is to allow the beneficiary to stretch out the benefits.  In light of recent Supreme Court decisions, there may be even more traps and/or benefits to the use of trusts.

2012-14 Trust and Estate Update: New Rules and New Tools
The Colorado legislature has been busy these last two years, implementing two uniform acts of particular importance to the practitioner and providing estate planners more techniques to add to their toolboxes.  The Colorado Court of Appeals has interpreted the applicability of spendthrift provisions and provided new guidance on fiduciary duties and roles. We expect more exciting news to come from the Colorado Supreme Court whether the privity rule will continue and whether a trial court has the ability to equitably adjust an elective share.
