Program Description:
 
This year, the case law update includes cases from the Colorado Supreme Court on authorizing equitable adjustments to the elective share of a surviving spouse, deference for a respondent's choice of guardian/conservator over family members, discussion of revocable trusts – including ratification of a co-trustee's conduct and creditor access to revocable trust assets. Legislation from the last year includes the revisor's bill, access to a decedent's safe deposit box, the banker's bill, and eligibility of a supplemental needs trust to receive PERA benefits.
 
 
MEET YOUR PRESENTERS:
 
Jamie J. Roth, Esq., is a partner at Brown & Brown, P.C. Her practice focuses on clients with needs in probate, litigation, estate planning, and conservatorships/guardianships. Jamie is Past President of the Ninth Judicial District Bar Association, a member of the Colorado Attorney Disciplinary Hearing Board, a former adjunct faculty member at Colorado Mountain College, and a member of Heeling Partners of the Roaring Fork Valley. She is also a contributing author to the Colorado Senior Law Handbook, the Elder Law Handbook and the Annual Survey of Colorado Law. She regularly prepares the case law update for the CBA Trust and Estate Section Council Notes. Jamie has lectured on estate planning practice and marketing, the case law update, probate administration, and tax issues for the Trust and Estate Section of the Colorado Bar Association.
 
Paul M. Smith, Esq., joined Brown & Brown, P.C., in 2012. His practice focuses on estate planning, estate and trust administration, guardianships/conservatorships, estate litigation and long term care planning. Paul practiced insurance defense litigation in Chicago and Albuquerque. He is licensed to practice law in New Mexico and Colorado. He is an active member of the Trust & Estate and Elder Law Sections of the Colorado Bar Association as well as a member of the Ninth Judicial District Bar Association, Mesa County Bar Association and New Mexico Bar Association. Paul is a co-author of the Trust and Estate chapter of the Colorado Annual Survey of Law. Paul has presented the Trust and Estate case law and legislative update for the Colorado Bar Association/CLE. Paul is also a member of the HopeWest Planned Giving Counsel and is a certified level 2 USA hockey coach.
