What's Next? The Uncertain Future of Estate Planning
With the passage of the American Taxpayer Relief Act of 2012, less than 1% of clients will have taxable estates. Many of the estate plans drafted when the federal estate tax exemption was much lower may no longer need their complex estate plans. When these clients come in for their periodic legal check-up, how should they be advised? What are the drafting options to address the changing dynamics in the estate tax laws? What aspects of their plans may still be suitable to retain for creditor protection, incapacity, remarriage, and irresponsible beneficiaries? What is your responsibility to contact clients to advise them of the need to review their estate plan? How has the public perception of the need for estate planning changed? What are the economic consequences for trust and estate attorneys in this new planning landscape, and where is the next generation of estate planners being trained?

Presented by David L. Starbuck, Esq., Baker Hostetler Law Firm, Denver, and L. William Schmidt, Esq., Jr., Senior Trust Officer, First Western Trust, Denver
