Now in its 32nd successful year, the Annual Estate Planning Retreat will be held on June 7-9 at the Beaver Run Resort and Conference Center in Breckenridge, Colorado. Co-sponsored by the Trust and Estate Section of the Colorado Bar Association and CBA-CLE, this event has become a longstanding tradition among Colorado trust and estate practitioners.  Attend to discuss the most important issues with some of the most experienced and knowledgeable trust and estate professionals in Colorado.

This annual advanced-level program is co-sponsored by the Trust and Estate Section of the Colorado Bar Association and CBA-CLE. The program is unique in that it primarily consists of interactive, small group discussions. Each registrant will participate in four out of eight highly active discussion groups LIMITED TO 20 PARTICIPANTS PER GROUP. Participants are prepared to join in with comments and questions because the course materials are mailed to each individual at least 2 weeks before the conference begins, providing each person with an opportunity to review the materials and actively join in the group discussions as facilitated by each presenter.

Most clients hope that their IRAs and qualified retirement plans will provide them with a comfortable retirement income and perhaps a legacy for their beloved family, friends or charities.  What happens when a retirement account owner or plan sponsor dies?  What planning choices are available?  What are their tax consequences, estate planning ramifications and potential penalties?  In this seminar, we will explore how to coordinate IRA and retirement plan beneficiary designations with the account owner's estate plan, what perils and pitfalls to avoid during the estate planning process and post-mortem planning opportunities.

Practical Solutions to Elder Financial Abuse and Fiduciary Theft
Financial abuse and fiduciary theft is on the rise.  It comes in many different guises.  Although the media typically covers some of the more heinous elder abuse cases each year, most abuses are committed by family members and relatively few are ever reported to law enforcement.  When a client first meets with you to discuss suspected abuse, or you happen upon a situation that appears questionable, the options available will vary widely with the particular situation.  This presentation will focus on practical solutions for practitioners and others to investigate and address possible elder abuse when those situations first appear.

Partnership Tax Basics
Understanding the use of partnerships, LLCs, and S corporations should be a part of every estate planner's “box of tools.”  This session will provide an introductory overview of the taxation of partnerships, LLCS and S corporations, differences between the taxation of those entities, and the use of those entities as part of a comprehensive estate plan.  Other specific topics discussed include the ability of estates to qualify as S corporation shareholders, the type of trusts that can qualify as S corporation shareholders, the use of discounts relating to LLC and partnership equity interests, the tax consequences of making “754 elections” under the partnership tax rules, distinctions between general and limited partners and control issues, and valuation rules relating to partnership, LLC, and S corporation interests under IRC sections 2701 through 2704.

A discussion of the technology, risks and rewards of various data storage methods available to an attorney, both in the office and in the cloud. The discussion will deal with both electronic information and “hard copy” files, and when and how to destroy them.  The presenters will also discuss the numerous ethics issues that pervade this part of the practice.  The group will discuss the various methods being used, and the possible benefits and pitfalls of these suggestions.

Duties, Pitfalls and Ethical Concerns of a Lawyer Serving as Fiduciary:  What You Need to Know
What does the estate planning attorney need to be aware of before agreeing to serve as Personal Representative or Trustee for a client? Particularly for small estates and trusts, or for larger estates with problematic assets and little liquidity, a corporate fiduciary may not be a viable option. What alternative solutions exist? What ethical and practical issues are raised when the drafting attorney serves as P.R. or Trustee?  This will be a discussion covering the basic duties and practical problems of serving as a fiduciary, the ethical issues of the lawyer serving as such, and suggestions for avoiding or mitigating the many liability traps and other practical pitfalls into which an unwary individual fiduciary can step.
