In re Marriage of Hogsett and its companion cases reinterpreted the standards—and added new ones—for common law marriage in Colorado. But do those cases create more clarity or confusion for trust and estate attorneys? How can estate planners provide predictability for their clients? What new factors complicate common law marriage claims? This presentation will address the changing picture of common law marriage, including the parties’ “sincerely held beliefs,” representations of marriage to the parties’ community(ies), and the elements that can support or undermine a litigated case.
