Program Description:
 
The development and use of directed trusts has increased in recent years. While the use of directed trusts is not novel, states have only recently begun developing a statutory framework for the powers, duties, and liabilities of parties to a directed trust. Colorado recently revamped its "Directed Trust" statute with the enactment of C.R.S. ยง 15-16-801 et seq., which became effective August 6, 2014. This presentation will (i) discuss the differences between a directed trust and a delegated trust; (ii) review Colorado's Directed Trust statute; and (iii) review the circumstances in which a directed trust may be appropriate and the considerations to be had when advising settlors and fiduciaries.
 
 
MEET YOUR PRESENTER:
 
Dylan Metzner, Esq., is a member of the Tax Trusts and Estates division in Stinson Leonard Street's Denver office. He represents individuals and families regarding private wealth planning. Dylan's clientele includes high net-worth individuals, corporate executives, closely held business owners and physicians. In serving his clientele, Dylan designs taxed advantaged entity structures, including family limited partnerships and limited liability companies, complex trusts, trusts structured to hold inherited qualified plans such as IRAs and 401K, split interest trusts, grantor trusts, life insurance trusts and buy/sell agreements. Dylan also advises his clients on choice of entity selection and maintenance. In all of these areas, Dylan assists clients in identifying their family goals and concerns and developing a strategy to address these goals and concerns in a tax efficient manner. In addition, Dylan represents fiduciaries, heirs and beneficiaries in the resolution of probate and trust-related disputes.
