Mental Health and Criminal Law: Where Do We Begin?

Program Description

Charges of criminal violations are often, and have always been, associated within a context of a person's mental health. There appears to be a trend, however, of increasing mental health complications for criminal defense attorneys. Additionally, our jails are often burdened with keeping the majority population safe, while individuals are not getting the medications and professional help needed.

This CLE will cover some of the commonly seen overlaps between criminal charges and a lack of volitional control, the attorney's role despite the client's best interests, and the practical policies and resources needed to address the fact that jails are often serving as de facto mental health facilities. It will also discuss things in the criminal arena that other practitioners, such as probate or family law attorneys, should be aware of when dealing with mentally ill clients.
