Emails! Metadata! Text messaging! Word processing documents! Spreadsheets! MySpace! Every imaginable form of electronic data has become a “smoking gun” of evidence in the courtroom today.  The difference between winning and losing your next case and depends upon your ability, skill and knowledge in handling requests for and production of electronic evidence.  Electronically Stored Evidence has become a critically vital part of litigation.  You must know how to prepare and be ready to amend your document retention rules once the duty to preserve evidence arises in order to avoid court imposed sanctions and disciplinary actions.
