Transnational Insolvency - Harmonizing and Unifying the Law on International Trade When Cross-Border Insolvencies Arise

Program Description:
 
With an increasingly globalized economy, transnational business failures and insolvencies are becoming more common.  Attend this program and be better prepared to counsel your clients and to navigate the complex arena of cross border insolvencies. Your presenters, a former U.S. Bankruptcy Court Judge and highly experienced private firm practitioner, will provide you with the background for the emergence of Chapter 15 of the U.S. Bankruptcy Code. They will also explain the Chapter’s purpose, provisions, and what the Chapter means for your practice.  They will then delve into how you use and implement Chapter 15, including the process and procedure of recognizing a foreign proceeding, the effect of recognition, international cooperation and diplomacy, and the tools available to a foreign representative. They will also address today’s use of Chapter 15 and how it has been refined and challenged, and the role of diplomacy and communication.

Meet Your Presenters:
 
Honorable Sidney B. Brooks, was appointed as a bankruptcy judge on January 4, 1988, and retired from the bench on January 3, 2016, after serving for 28 years. Additionally, Judge Brooks has lectured, taught courses, conducted seminars, and written for numerous professional organizations, schools and publications. On behalf of the Library of Congress' Open World Leadership Program and The World Bank, Judge Brooks assisted with the development of judicial training and court management programs. He has also worked with and advised judicial officials from Russia, Kazakhstan, Kyrghistan, Mongolia, the People's Republic of China, Poland, Macedonia, Thailand, Mexico, India and Canada with regard to international commercial/insolvency law and court administration and judicial affairs. Among other positions and activities, Judge Brooks has been a member of or served as advisor to: International Judicial Relations Committee of the U.S. Judicial Conference; American Law Institute NAFTA Bankruptcy Law Project Advisory Committee; American Bar Association Central and East European Law Initiative Advisory Committee; American Bankruptcy Institute/INSOL; Federal Judicial Center Board of Directors; Federal Judicial Center Bankruptcy Education Committee; International Law Relations Committee of the National Conference of Bankruptcy Judges; European Bank for Reconstruction and Development; The World Bank; Organization for Economic Cooperation and Development; and the National Judicial College. Judge Brooks is a graduate of the University of Denver, College of Law. He previously served as assistant attorney general for the State of Colorado, and was in private practice for 16 years, with emphasis in bankruptcy and reorganizations, litigation, commercial transactions, and general business law.  
 
 
Robert D. Lantz, Esq. is a member of the law firm Coan, Payton & Payne, LLC in Denver, Colorado where he practices in all areas of real estate and business law, bankruptcy, banking law and commercial litigation. His commercial and bankruptcy experience goes back twenty-five years and includes Chapter 11 and 7 debtor representation, creditor representation and trustee representation. Outside of bankruptcy, he has significant experience with corporate restructuring and reorganization, foreclosures, distressed property reorganization and commercial real estate. Before joining Coan Payton & Payne, LLC, he worked with a boutique law firm in downtown Denver specializing in all areas of bankruptcy as well as commercial and real estate litigation. Before that, he spent thirteen years as the Law Clerk to the Honorable Sidney B. Brooks. Mr. Lantz began his career in Kansas City, Missouri as a staff attorney for the U.S. Department of Justice, Office of the United States Trustee and then as an associate with a private law firm representing creditors, banking institutions, and the FDIC and RTC around the U.S.
