Filing Petitions for Writ of Habeas Corpus for Immigrants Detained in the District of Colorado

The Issue:
The number of people held in U.S. federal immigration detention is unprecedented. In January 2026 alone, Immigration and Customs Enforcement (ICE) detained 39,694 people. At the same time the federal government has ramped up enforcement actions, the agencies charged with administering immigration law have adopted a restrictive statutory interpretation, now finding that most people in immigration custody do not qualify for release. The sole mechanism to challenge unlawful detention and restore people’s liberty is through filing habeas petitions.

 

Why It Matters: 
In detention, people are separated from their loved ones, employment, and education. Additionally, movement is restricted while medical and mental health services are very limited. Detention also imposes barriers to accessing counsel and becomes a disincentive to fighting a case. This is particularly harmful to people who fled persecution and torture as well as survivors of crimes and human trafficking.

 

Release from detention allows individuals the ability to better prepare their immigration cases and be together with loved ones during the process.

 

How You Can Help:
This course will provide the tools you need to get started if you have yet to file an immigration habeas petition and it will sharpen your skills if you are new to this area of practice. A group of experts will walk you through the ins and outs of filing habeas petitions, answer burning questions, and offer robust materials that will ease the burden of learning how to file and present habeas petitions in the District Court for the District of Colorado with a litigation goal focused on securing clients’ freedom from detention.

 

Please note that volunteer opportunities at RMIAN are subject to mentor availability. As such, CLE program attendees will not be penalized for not completing the volunteer commitment within the stated timeframe.  

 

The Rocky Mountain Immigrant Advocacy Network (RMIAN) is a nonprofit organization that provides free immigration legal services to children and to individuals in immigration detention. RMIAN provides daily know-your-rights presentations, individual intakes, pro se assistance, and legal representation for those detained at the federal immigration detention facility in Aurora. RMIAN’s Children’s Program represents children and families who have survived abandonment, abuse, persecution, or other violence, and provides technical assistance and community education throughout the state on children’s immigration law issues. Unable to meet the overwhelming need for legal services, RMIAN refers both detention and children’s clients’ cases to its network of pro bono attorneys. RMIAN screens pro bono cases, writes referral memorandums, and provides professional liability insurance and a mentor attorney for each pro bono attorney.


 

CLE CREDITS: This program has been submitted for 4 General CLE Credits.

 

 

The program is accredited in Colorado. CBA-CLE staff can provide a Uniform Certificate of Attendance, and it is the attendee's responsibility to complete the accreditation outside of Colorado.
