Limitations on 2nd Amendment Right to Bear Arms After Rahimi - Webinar

On June 21, 2024, SCOTUS issued its decision in United States v. Rahimi, finding 18 U.S.C. ยง922(g)(8), which prohibits an individual subject to a domestic violence restraining order from possessing a firearm, to be constitutional and not in contravention of the 2nd Amendment to the U.S. Constitution. Eight of the current Justices concurred in the opinion, with only Justice Thomas dissenting. Although the concurring opinions exhibit the Justices’ varying thoughts on originalism, Justice Robert’s opinion for the Court makes clear that there is no need for a “historical twin” past regulation in order to support the constitutionality of a contemporary regulation or statute. Join University of Colorado Law School Professor Jonathon Booth for his analysis of the decision, the Court’s reasoning in getting there, and the impact the decision may have on future 2nd Amendment litigation.
