Program Description:
 
Circumstances often change after a divorce. Colorado law provides for post-decree modifications. The parties must petition the court for a modification, and the court must approve the modification. There are consequences for parties who do not abide by dissolution of marriage orders without seeking court permission. At the Family Law Fall Update, navigate the labyrinth of post-decree modifications of jurisdiction, parental responsibilities, maintenance and child support. Lunch Presentation: Is It Best Interests or Endangerment? Post Decree Modification Standards and How They Mislead and Confuse Practitioners
This segment will explore the age-old inquiry, “Which standard applies when modifying parenting time and decision-making?” This section will focus on the applicable statutes and case law, providing the practitioner with different scenarios to learn which modification standard (best interests or endangerment) applies. The segment will also address modification standards in third-party cases, the timing of filing modification motions, modifications of a child’s primary residence, and restrictions on parenting time.
