Divorcing with Different Rules: Navigating the Unique Challenges and Issues Presented by Marital Agreements

Program Description
Marital agreements present unique challenges for domestic relations practitioners, especially young attorneys, as their primary purpose, in the context of divorce, is to alter the rules and concepts that underpin dissolution of marriage proceedings in Colorado. This CLE will provide an overview of the rules that govern the formation of marital agreements, including matters that may appropriately be addressed in marital agreements, in order to analyze whether a marital agreement is enforceable or whether it may be challenged. You will also learn methods to assist in analyzing and preparing a case for trial concerning the validity of a marital agreement and for the ultimate permanent orders hearing.
