Blurring the Lines - Cross-Border Practice of Law - LIVE IN DENVER
 
 
Program Description:
 
Lawyers are increasingly crossing state borders when representing clients. This program will address the ethical questions posed by out of state lawyers practicing in Colorado - both for the lawyers themselves as well as those who may face them in an opposing position. This program will also give the Colorado lawyer basic tools for analyzing the appropriateness of their conduct when they practice in another state.
 
With a discussion of Colorado Rules of Professional Conduct and Civil Procedure, this program will look at evolving trends in multijurisdictional practice and address questions, including:
1) What is your recourse when you have concerns about the conduct of opposing counsel, who is practicing in Colorado pro hac vice?
2) Do pro hac vice attorneys always have to have in-state co-counsel?
3) Should you report the in-state counsel to disciplinary authorities along with the pro hac vice attorney if there are ethical concerns?
4) Is it ethical for an attorney in Colorado but licensed elsewhere to practice in this state if they are performing federal only legal work? How and where would you file a disciplinary complaint if necessary?
5) Can a person licensed in another state but physically located in Colorado “practice” in this state if they only accept cases and clients from the state where they are licensed?
There will also be discussion of ABA Model Rule 5.5 and potential “traps” for Colorado lawyers who cross state lines, such as:
1) What are the basic ground rules used by a majority of states concerning cross border practice?
2) What are the developing trends for cross border practice including a discussion of ABA Models concerning issues such as practice pending admission, admission on motion, temporary legal services, and approaches adopted by the European Union and other countries?
3) Where do you find the specific applicable rules and laws for other states concerning multijurisdictional practice?

Faculty:
 
Amy C. DeVan, Esq., is Assistant Regulation Counsel for the Colorado Supreme Court Office of Attorney Regulation Counsel in Denver, Colorado. In this role, she investigates allegations of lawyer misconduct pursuant to the Rules of Professional Conduct. Prior to joining the Office of Attorney Regulation Counsel in 2010, Amy was employed in private practice for nine years with a boutique immigration law firm in the metro area. A graduate of the University of Colorado School of Law, Amy is also a member of the Colorado Bar Association, where she serves on the Bar Association Ethics Committee and chairs the Education Subcommittee of the Ethics Committee.
 
Jim Coyle is Chief Deputy Regulation Counsel for the Colorado Supreme Court Office of Attorney Regulation Counsel. He has been with the Office since 1990. For the first 10 years with the Office, Jim prosecuted lawyers in disciplinary, disability, and contempt proceedings; represented the Board of Law Examiners in admissions cases; and represented the Unauthorized Practice of Law Committee in investigating and prosecuting injunctive and contempt proceedings against non-lawyers. From 2001 through 2011, Jim supervised the trial division of the office. Jim has also acted as counsel for the Colorado Commission on Judicial Discipline. Jim now supervises the intake division of the office, as well as office operations and administration, attorney admissions processes, CLE regulation and inventory counsel duties.
 
Jim remains actively involved in the American and Colorado Bar Associations. He has served on national and local committees involving attorney regulation, U.S. cross-border legal practice, and international cross-border legal practice. Jim has testified before the ABA Ethics 20/20 Commission on cross-border legal practice issues. Jim does presentations for the American Bar Association, National Organization of Bar Counsel, Association of Professional Responsibility Lawyers, National Client Protection Organization, Colorado Bar Association, and other groups on various professional responsibility and practice of law topics.
