Morning Program Description:
 
Recent statistics claim that “more than 90% of all corporate information is electronic and that less than 1% of all communication will ever appear in paper form.  In order to comply with state ethics rules on competence, attorneys must be technologically competent.  CBA President, Paul Chan, will discuss the issues, case law and ethics rules related to securing and safeguarding confidential client information, emails, metadata and social networking.
 
Recent cases make it clear that you can and must know where to look in social media as well as email and the Internet for information relevant to your case.  But some jurisdictions forbid you from looking at the metadata associated with some of the digital information you are required to find. David K. Isom examines what a Colorado lawyer must find, and what a Colorado lawyer must ignore, to do electronic discovery competently and ethically.
 
Law blogs, Twitter, Facebook, and other social media offer innovative and constantly evolving ways to market a lawyer's practice.  However, the power, speed, and accessibility of new media give rise to numerous potential ethical pitfalls.  Paul Karlsgodt will explore strategies for using social media in legal marketing while avoiding ethical problems such as violations of restrictions on attorney advertising and trial publicity, conflicts of interest, and breaches of client confidentiality.
