The problem of the inadvertent disclosure of communications or information that is privileged or protected is not new. However, the risk of such disclosures has increased dramatically in recent years as a result of rapid communication such as e-mail, and in the litigation context, with the production of large volumes of documents and information, especially electronically stored information. Consequently, the rules governing inadvertent disclosure have been evolving rapidly to keep up or catch up with the problem.
 
Topics to be discussed include:
- Inadvertent disclosure implicates several areas of substantive law: legal ethics, civil procedure, and evidence.
- Similarities and differences between the Colorado and federal approaches.
- Separate and distinct issues for the lawyer who inadvertently discloses the information and the lawyer who receives it.
- Inadvertent disclosure as waiver of protection or privilege.
