Program Description
Family Responsibilities Discrimination (FRD) (also known as caregiver discrimination) claims are on the rise. Attorneys need to be prepared to address such claims internally and on behalf of their clients. Come to this program and learn:
- The legal and social history of FRD, including a discussion of the increase in FRD cases;
- What laws are used as the basis for these claims, including legislation trends regarding FRD;
- Recent court opinions and EEOC guidance addressing FRD claims;
- When an employer needs to make accommodations for the caregiving responsibilities of employees; and
- Why maternal profiling and other traditional stereotyping have led to huge jury verdicts against employers.

Michelle B. Ferguson is a partner with Ireland Stapleton Pryor & Pascoe, P.C. where she is a member of the employment law and special districts practice groups. Michelle's practice focuses on “preventative” employment law - finding ways to keep employers out of court by being proactive in identifying and addressing employment law issues before an employee files a claim. Along with representing employers in litigation and an array of administrative proceedings, Michelle provides day-to-day advice to employers of all shapes and sizes on all areas of employment law. Michelle routinely provides in-house training for employers and their employees, conducts independent investigations into allegations of discrimination and retaliation, and conducts internal FLSA and Form I-9 audits.
Michelle received her Bachelor of Arts from Washington University in St. Louis in 1995 and graduated magna cum laude from American University's Washington College of Law in 1998. Named a Rising Star in Employment Law in "Super Lawyer" magazine the past two years and the DBA's 2006 Young Lawyer of the Year, Michelle is an active member of various civic and charitable organizations throughout the Denver-metro area.

Charlotte Sweeney
Charlotte's practice is devoted to employee-side employment law, with an emphasis on employment discrimination issues. She represents both private and government sector employees in matters of discrimination, harassment, civil rights, wrongful discharge, contractual disputes, and other federal and state law claims related to all phases of the employment relationship. Charlotte is a frequent lecturer regarding employment law and employment litigation.
Charlotte has been named as one of The Best Lawyers in America in the specialty of Labor and Employment Law. She has been recognized as a Colorado Super Lawyer in the area of Employment Law, an honor limited to five percent of Colorado attorneys, every year since the program's inception in 2005. Charlotte served as the Co-Chair of the Colorado Bar Association's Labor and Employment Section from 2007-2009. Since 2003, she has served on the Board of Directors of the Colorado Plaintiff Employment Lawyers Association (PELA), and formerly served as President of PELA in 2005 and 2006. She is the current co-chair of the Faculty of Federal Advocates Committee charged with drafting Model Employment Law Jury Instructions for use in the U.S. District Court for the District of Colorado.
