Employment Law Practice & Procedure

April 2005

Designed for the beginning practitioner or anyone seeking a refresher to the practice and procedure of employment law, The ABCs of Employment Law has exactly what you need.

Our morning begins with an introduction into conducting an investigation.  You will hear our experienced investigator discuss traps that employers fall into at the outset.  Additionally, you will hear defense counsel's perspective on the appropriate steps to take while undergoing an investigation.  The morning continues with a view from plaintiff's counsel.  Our plaintiff's counsel discusses considerations on how to evaluate not only the claim but also, the client and case in order to determine the likelihood of success.  The morning concludes with a look at common discovery issues such as privacy matters, protective orders, and psychological and emotional claims.  Hear both sides of the story as plaintiff and defense counsel present their experiences from over the years.

The afternoon starts off with damages, specifically, you will hear defense and plaintiff's perspectives on factors to consider when assessing and calculating damages.  Included in their discussion will be wage and benefit losses, damages for emotional distress and punitive damages.  The afternoon continues with another important topic on settlement and mediation.  You will want to hear our experts discuss how to prepare the case and client for mediation as well as how to maximize your opportunities during mediation.  The day concludes with a view from the bench.  Don't miss this last segment as our federal magistrate judge shares his insight into the judicial process!
