A lawsuit is never won based on the strength of pre-litigation correspondence, a charge of discrimination, or a position statement, but attorneys unaware of common traps may well lose a lawsuit before it ever begins. This presentation will focus on what employment lawyers – whether for plaintiffs or defendants – need to focus on at the outset of a dispute and what tactics are likely to result in a favorable outcome for
our clients. Topics include the exchange of demand letters and responses, entering into enforceable employment agreements, communicating with government agencies investigating the workplace, and litigation holds.

Framing the Case: Best Practices for Initial Pleadings on Both Sides of the ‘V’
This presentation will address how practitioners can best frame the plaintiff and defense sides of employment cases to posture the case early. Ms. Wells and Ms. Quintana will discuss the more recent rule changes and state case law setting forth seemingly different standards for initial pleadings, as well as considerations for state law versus federal law claims. Additionally, this presentation will cover the interplay of Rule 8 with other rules of procedure and the impact of initial pleadings on pretrial conference preparation.

Practical Tips for Drafting Jury Instructions in Employment Cases
Trials are rare and the stakes are high. So much of the work practitioners put into cases is focused on obtaining—or avoiding—summary judgment, that jury instructions are often overlooked or go by the wayside until late in the case when the lawyers are more focused on other aspects of trial preparation. Rushed drafting or over-reliance on pattern jury instructions may turn months or years of hard work into defeat. In this session, we’ll cover tips and strategies for dealing with this crucial aspect of litigation.
