A. Discovery, Evidence and Procedure: The Rules You Need to Know
 
Because of the focus on speedy administration of probate matters and equitable relief under the Probate Code, there is a myth that attorneys representing clients in contested matters under the Code do not need to know the "civil rules." This session debunks the myth. Participants should expect practice tips for discovery under C.R.C.P. Rules 27-37 using new Rule of Probate Procedure, Rule 37; a discussion of evidentiary short cuts found in the Colorado Rules of Evidence; and a refresher course in motion practice under the Colorado Rules of Civil Procedure.

B. Guardian ad Litem vs. Court-Appointed Counsel in Probate Matters: A Distinction WITH a Difference
 
Many elder law attorneys confuse the difference between a Guardian ad Litem and a court-appointed attorney in probate matters. The two roles - and the associated responsibilities - are quite distinct. Learn about the different standards applied to each role, what is expected of an attorney appointed to serve in either position and how both a GAL and counsel can assist the parties and the court in difficult probate matters.

This session will outline what is needed for a Law Enforcement Investigation and what requirements are placed on the Law Enforcement agency upon taking the report.
