Program Description:
 
Title III of the Americans with Disabilities Act (ADA) requires that private entities, including lawyers’ offices, provide auxiliary aids and services necessary to ensure effective communication with persons who are deaf and hard of hearing. Unfortunately, many lawyers do not know about this legal requirement and are unfamiliar with the various auxiliary aids and services that may be employed to comply with the Act. Further, because there is often an expense involved in employing these aids or services that cannot be passed on to the client — and the risk of civil liability and penalties if the Act is violated — it is particularly important for lawyers to know the extent of their obligations to this population and what resources are available.
 
This program will provide you with the specifics about a lawyer’s obligations under Title III of the ADA that are applicable to their work with individuals who are deaf or hard of hearing; outline the types of accommodations that are available for working with this population in a culturally affirmative manner (and how to use those accommodations); explore the challenges that deaf and hard of hearing people face in obtaining legal representation; explain how to work with a sign language interpreter; and share resources that are available to Colorado Bar Association members who may find the need to provide sign language interpreters for effective access to communication.
 
 
 
MEET YOUR PRESENTERS:
 
Dr. Timothy Chevalier is Outreach and Consultative Services Manager for the Colorado Commission for the Deaf and Hard of Hearing (CCDHH). Dr. Chevalier feels that one of his greatest gifts from his Deaf parents was to become bilingual—fluent in American Sign Language and English. Dr. Chevalier oversees the education, training and consultation provided to state and local governmental agencies, public accommodations and community-based organizations related to effective communication access to the deaf and hard of hearing community.
 
Jack D. Robinson, Esq., is an attorney and co-founder of the law firm Spies, Powers & Robinson, P.C., where his primary practice area is special education law and educational discrimination. Mr. Robinson has been representing the interests of children with disabilities and their parents for over twenty years and is a frequent lecturer on the application and construction of the Individuals With Disabilities Education Act, the Americans with Disabilities Act, Section 504 of the Rehabilitation Act, and the Family Educational Rights and Privacy Act. He has represented clients in numerous due process proceedings, civil actions, and appeals. Mr. Robinson is counsel of record for the student and his parents in Endrew F. v. Douglas County School District RE-1, a case in which the United States Supreme Court’s decision in favor of the student greatly expanded the rights of all children with disabilities. Mr. Robinson is the founder of the Colorado Council of Special Education Lawyers and is a former member of the Colorado Special Education Advisory Committee.
