The Bias Conversation, Two Years On: Criminal Rule 24(d)(5) and Jury Selection - In-Person

In May 2023, the Criminal Law Section of the Colorado Bar Association and CBA-CLE brought together prosecutors, defense attorneys, a judge, scholars, and community members for a candid discussion on race and implicit bias in the criminal justice system. One highlight was a panel that evaluated the then proposed Implicit Bias Rule, Criminal Rule 24(d)(5), and its potential impact on jury selection.

 

Two years later, on June 26, 2025, the Colorado Supreme Court adopted Criminal Rule 24(d)(5) Improper Bias, effective January 2, 2026. This program reconvenes most of the original panel, joined by additional practitioners, to discuss the newly adopted rule, what has changed since 2023, and what developments, if any, in the law and practice may influence its application.

 

The second session, Explicit Bias, Implicit Bias, and Jury Selection, will delve deeper into both forms of bias, exploring how they shape juror attitudes, attorney strategy, and trial outcomes. Together, these presentations revisit the critical conversation on race and bias as they continue to impact the criminal justice system, particularly in the vital context of jury selection.
