2024 Business Law Institute - Webinar

Business attorneys are set apart from other attorneys by the breadth of their practices. The businesses you represent are depending on you to understand a myriad of issues that impact their bottom line, whether it be corporate formation and governance, intellectual property protection, antitrust regulations, securities regulations, general litigation, or employment law. At the Business Law Institute, we will prepare you for the unique challenge of business practice by providing expert instruction on a broad spectrum of the hottest legal issues being faced by businesses today. You will also enjoy Professor Richard Wobbekind’s annual look into Colorado’s economy, have opportunities to network with other attorneys, and recognize a Colorado business law legend at our Thursday reception in honor of this year’s Cathy Stricklin Krendl Lifetime Achievement Award recipient. Internal Investigations: Practical, Legal, and Ethical Considerations for Business Lawyers
Good corporate governance requires attention to potential wrongdoing within a company. In house and outside corporate counsel have certain reporting obligations, and they typically play a significant role in helping the company decide whether and how to investigate potential wrongdoing and navigate the fallout from the investigation. Planning is the first step of a well-executed investigation. This presentation will provide a roadmap of critical issues for corporate counsel to consider in planning an investigation, including selection of the oversight body and investigative team, scoping and budgeting, insurance and advancement of expenses, factual investigation, protecting privilege, communicating with auditors, and recording the process and conclusions of the investigation. We will focus in more detail on those areas that pose ethical concerns.
