Join us for a discussion of hot topics and critical updates impacting your nonprofit clients. Along with our annual tax and employment law updates, we’ll discuss disaster relief and employee assistance funds, charitable giving, the current status of the PPP program, and religious institutions and COVID-19 at the Supreme Court.

The program will be submitted for CLE accreditation in Colorado. If you need to seek accreditation in another state, please review the process and requirements for that individual state. CBA-CLE staff can provide a Uniform Certificate of Attendance, and it is the attendee’s responsibility to complete the accreditation outside of Colorado.

COVID, Church Closures, and the Constitution
Pandemic-related restrictions imposed on churches have led to scores of lawsuits by churches asserting First Amendment rights. Churches have filed more than a dozen emergency applications to the U.S. Supreme Court. Three major cases, Roman Catholic Diocese of Brooklyn v. Cuomo, South Bay United Pentecostal v. Newsom, and Tandon v. Newsom have developed a more robust Free Exercise doctrine that informs the major Free Exercise case, Fulton v. City of Philadelphia, decided this summer.

Disaster Relief and Employee Assistance Funds
When disaster strikes, employers are often in the best position to help their employees weather financial storms. We will discuss various forms of Employee Assistance Funds, including Section 139 Disaster Relief Payments, and employer-Sponsored Disaster Relief Funds hosted by a community foundation or other third-party 501(c)(3) public charity sponsors.

Charitable Giving
You know the routine: You make a charitable contribution, and you get a charitable contribution deduction. But how well do you really know the rules related to the deductibility of charitable contributions and the many ways charitable contributions can be made? This presentation will provide an overview of Section 170 of the Internal Revenue Code, which provides the basis for the deductibility of charitable contributions and review some of the provisions of Section 170 that limit deductibility. We will also discuss some of the alternative methods for making charitable contributions, such as gifts of remainder interests, part gift/part-sale transactions, donor advised funds, private foundations, split-interest trusts (charitable remainder trusts and charitable lead trusts), and charitable gift annuities.
