2014 SUPPLEMENT
As we went to press on the 2014 Supplement, an announcement was made by President Barack Obama that he will use his authority to implement several executive actions that will impact immigrants in Colorado and throughout the United States. The announcement is so recent that we do not yet know exactly how or when it will be implemented. However, any practitioner using this book should be aware that major changes are taking place across the immigration landscape.

Updates to the 2014 Supplement include:
  • The new electronic I-94 Arrival and Departure Record procedure.
  • Eligibility for immigrants under the Patient Protection and Affordable Care Act and unemployment insurance.
  • Benefits for same-sex couples and unaccompanied children.
  • Chapter 20, “The Federal I-864 Contract: Requirements and Obligations- A complete revision.

Important case law discussed include:
  • United States v. Windsor -The U.S. Supreme Court landmark civil rights case that held that restricting U.S. federal interpretation of "marriage" and "spouse" to apply only to heterosexual unions in the Defense of Marriage Act (DOMA) is unconstitutional.
  • Kitchen v. Herbert- The federal case that successfully challenged Utah's constitutional ban on marriage for same-sex couples and similar statutes.

FORMS  - Forms have been updated to reflect the most current version, plus new ones added, including:
  • Form I-601A, Application for Provisional Unlawful Presence Waiver
