About the Book:
The purpose of this book is to furnish the reader with a comprehensive review of Colorado's wrongful death law. The text not only looks at the current state of the law, but examines its historical development as well. Where appropriate, the book provides critical analysis of major court decisions and identifies questions that remain unanswered. To put legal issues in the proper context, the text contains factual summaries of important cases. Study of this book should equip the practitioner to address most legal issues likely to arise in the handling of a wrongful death case in Colorado.
 
This Fifth Edition of the Handbook of Colorado Wrongful Death Law includes an extensive discussion of cases as well as the interplay of case law and statutes. Readers will find discussion of major amendments to the Wrongful Death Act under HB 24-1472, effective January 1, 2025; standing to sue for siblings of the decedent; economic damages recoverable against health-care professionals and health-care institutions; reflections on “tort reform”; the one action rule’s bar on a second wrongful death claim where a plaintiff filed a claim, settled it, and dismissed it without prejudice; expanded discussion of standing of adult adoptees as heirs; governmental immunity in connection with the death of an incarcerated person; whether knowledge or conscious disregard of a health danger constitutes willful and wanton conduct under C.R.S. § 24-10-118(2); whether a wrongful death action against owner of a long-term care facility was subject to a mandatory arbitration clause where the agreement was not signed and a copy was not provided to the parents of deceased daughter and, therefore, did not substantially comply with the provisions of the Health Care Availability Act; whether a wrongful death action stemming from an apartment fire arose under the Premises Liability Act and was not subject to mandatory arbitration under a provision in the lease requiring arbitration of all disputes arising in connection with the lease; whether the risk of an active shooter at an abortion clinic was sufficiently foreseeable as to preclude summary judgment in wrongful death action under the PLA against the clinic owner; whether the McHaffie Rule applies to bar a negligent hiring claim when the plaintiffs do not assert an employer is vicariously liable for the negligence of an employee, even if the employer admits in its answer that the employee’s alleged negligent acts occurred during the course and scope of employment; and whether the vendor of alcoholic beverages was liable for wrongful death under the Colorado Dram Shop Act for the sale of alcohol to a visibly intoxicated patron who did not consume the alcohol before causing the fatal accident.
