Colorado Estate Planning Forms, 2014 Supplement Out of Stock

Contributors:  Estate Planning Forms Committee - CBA Trust & Estate Section
Publisher: CLE in Colorado, Inc.
Supplement Publication Date: October 2014

About the Supplement:

The following items are included in the 2014 Supplement to The Orange Book - Colorado Estate Planning Forms:

- The Orange Book was updated to reflect the new Colorado Civil Unions Act, C.R.S. ยงยง 14-15-101, et seq. A new section regarding use of the forms for partners in a civil union was added to the caveats. Gray boxes throughout the Orange Book were updated regarding the appropriateness of the forms for partners in a civil union. Certain form provisions, such as the remote contingent distribution provision and relevant Notes on Use, were updated throughout the Orange Book. Note, however, that many of the forms themselves will need further modifications for use with partners in a civil union and the caveats, forms, and Notes on Use must be carefully reviewed. The practitioner will notice that a significant number of the Orange Book forms were updated with regard to the Civil Unions Act, as well as the subsequent United States Supreme Court cases addressing the federal rights of couples in same-sex marriages.
- Tab A-General and Administrative Provisions. Updated death tax apportionment language. Language throughout the Orange Book has been updated to be consistent with the new death tax apportionment statute.
- Tab B-Special Provisions. The QDOT drop-in provisions and related Notes on Use were updated.
Forms 22A and 22B-Estate Planning Questionnaires. These forms and corresponding Notes on Use were updated to provide additional provisions concerning adoptees.
- Form 25-Memorandum: Funding Your Revocable Living Trust. This form was updated to add references to the Colorado Lawyer article regarding small estate affidavits and the Department of Motor Vehicles requirements regarding transferring motor vehicles.

The forms in The Orange Book are prepared by the volunteer members of The Orange Book Forms Committee of the Trust & Estate Section of the Colorado Bar Association. The forms are intended to provide guidance and general suggested language to assist the lawyer in preparing estate planning documents; they are not intended to be a substitute for the exercise of the lawyer's own professional judgment in planning a client's estate. No form or language in The Orange Book should be used unless the lawyer fully understands the purpose, meaning, and tax consequences of the form and language.
