The year 2013 saw very few cases in the area of eminent domain. This case law review provides an analysis of two new cases, one of which may have a significant impact on in limine motions practice and trial procedure. In both 2013 cases, petitions for certiorari remain pending in the Colorado Supreme Court. In addition, there are several other cases currently pending in the Colorado Court of Appeals arising out of the FasTracks light rail projects ongoing throughout the metro-Denver area, so there are likely to be several new decisions in 2014.
