ABOUT THE CHAPTER:
The judicial and legislative branches were busy in 2013 regarding construction law issues. In fact, although very rare, the U.S. Supreme Court decided a case involving the enforceability of contractual forum-selection clauses in a construction dispute context. The Colorado judicial system decided a variety of cases, including several on the economic loss rule, as well as clarifying the Colorado construction trust fund and bond statutes. The legislature passed five bills, including two affecting workers’ compensation. The following is meant to provide you with a brief overview of the major decisions in 2013, with citations to allow you further research, if you desire.
