Much like 2011, the Colorado appellate courts in 2012 issued opinions addressing a wide range of topics pertinent to the “torts” practitioner. Every aspect of tort claims, from the existence of a duty through available damages were addressed. The Colorado Supreme Court issued a number of notable decisions addressing various issues, including application of the collateral source rule to medical expenses paid by health-care insurers, commercial loss-of-use damages, fiduciary duty, and trebling exemplary damages pursuant to statute. The court of appeals was also busy, issuing numerous opinions impacting virtually every aspect of tort law. This includes the existence, or lack of, a duty with respect to both negligence and fiduciary obligations, the economic-loss rule, causation, mitigation of damages, and medical malpractice. The court of appeals also weighed in on the premises liability and dog-bite statutes, insurance bad faith, governmental immunity, application of the doctrine of res ipsa loquitur, and many other issues. The legislature was relatively quiet, largely limiting itself to minor modifications of existing law such as the Colorado Professional Review Act and the Colorado Governmental Immunity Act. The legislature did, however, look to the future, enacting C.R.S. ยง 41-6-101(b), which ensures negligence waivers can be enforced when civilians are ultimately permitted to participate in space flight. All in all, it was a busy year for tort-related law, and we will see if this trend continues in 2013.
