The present economic climate has been referred to as the “Great Recession” by some commentators. This is an illusion to the fact that the country has not seen a comparable downturn in magnitude or duration since the Great Depression of the 1930s. Bankruptcy filings have dropped during 2011 in all but a few districts. This may reflect more about the pipeline of debtors having been depleted than any real economic recovery. Nonetheless, the bankruptcy system may see some relief from an avalanche that has strained resources. Two bankruptcy cases will be heard during the present term by the Supreme Court: Hall v. United States,
a Chapter 12 taxation case, and RadLAX Gateway Hotel v. Amalgamated Bank, in which the issue is whether a Chapter 11 plan can involuntarily prohibit a
secured creditor from credit bidding for assets of the debtor’s bankruptcy estate, a Chicago hotel in this case.
 
Few opinions from this year are revolutionary. Many fewer published opinions were released this year as opposed to prior years. The state of bankruptcy law is
becoming ever more stable as BAPCPA law becomes more heavily construed and courts reach more of a consensus about the proper interpretation of its provisions.
