The state of Colorado had another busy water law year. This ever-changing area of law saw changes addressing both current and future water rights and
water quality issues. The Colorado Supreme Court decided cases involving plans for augmentation, water taps, effluent, exchanges, and the ever-present issue of
injury to vested water rights. The Colorado Ground Water Commission decided several cases regarding large-capacity wells pumping designated ground water,
and subsequently amended its Rules accordingly.
The Commission also considered the issue of creating a new designated basin and de-designation of portions of an existing basin, with both of those issues to ultimately be decided in future proceedings. The Colorado legislature considered a variety of bills primarily focusing on water conservation and enforcement. The following article provides a brief overview of the variety of issues and concerns facing Colorado water law not only in 2010, but also in the foreseeable future, as well as how the courts and other officials are currently handling these issues.
