This article discusses interesting cases from 2010 in the Colorado state and federal courts concerning the law of alternative dispute resolution. For example, this article reports on several cases where courts address whether a particular issue should be resolved by a court or, instead, by an arbitrator. Several other cases discuss whether a party waived the right to arbitrate. In addition, the federal district courts issued several decisions that should assist practitioners in arguing for or against a stay of discovery pending the court’s decision on a motion to compel arbitration. In 2010, the Colorado Court of Appeals decided an issue regarding the effect of incorporating rules of the American Arbitration Association that change over time differently from a Colorado U.S. District Court judge who decided nearly the same issue six months earlier. These and other interesting cases concerning the law of alternative dispute resolution are described in this article.
